This paper presents a specific concept of the legal system, bringing a contribution to the Theory of Law, from the line of analysis of the Semiotics of Law. The entire methodological approach of this concept is based on the contributions of the École de Paris, from a theoretical-semiotic perspective derived from the studies of Algirdas Julien Greimas. The analysis seeks to further and qualify previous studies and publications, and focuses on the task of presenting the concept of juridicity, deriving the (...) description of the concept of the legal system from it, understood as a set of connections between legal texts. Consequently, the paper presents a Mesh Model for the description of the legal system, replacing the positivist concept of the Pyramid Model, through restoring the relationship between Law and Moral, between Law and Society and Law and Justice. Throughout the theoretical explanation, the paper tries to trace, develop and qualify the main points with arguments that distinguish the operation of the legal system, such as the concentric movement, micro-universes of meaning, discursive practices, the task of legal actors, dynamic inter-textuality, the role of interpretation, the process of the production of legal meaning and the search for textual justice. Progressive supranuclear palsy is a movement disorder with prominent tau neuropathology. Brain diseases with abnormal tau deposits are called tauopathies, the most common of which is Alzheimer's disease. Environmental causes of tauopathies include repetitive head trauma associated with some sports. To identify common genetic variation contributing to risk for tauopathies, we carried out a genome-wide association study of 1,114 individuals with PSP and 3,247 controls followed by a second stage in which we genotyped 1,051 cases and 3,560 controls for the (...) stage 1 SNPs that yielded P ≤ 10-3. We found significant previously unidentified signals associated with PSP risk at STX6, EIF2AK3 and MOBP. We confirmed two independent variants in MAPT affecting risk for PSP, one of which influences MAPT brain expression. The genes implicated encode proteins for vesicle-membrane fusion at the Golgi-endosomal interface, for the endoplasmic reticulum unfolded protein response and for a myelin structural component. © 2011 Nature America, Inc. To overcome the paradoxical situation in which the modern subject finds itself, on conceptualizing nature in such a way that its very presence in nature becomes inconceivable, modernity supplied at least four alternatives: a) the first is to defend dualism ; b) the second option is to support a monism of nature ; c) the third alternative is to defend a monism of subjectivity ; d) the fourth and last alternative is to support a dialectical monism. It is well known (...) that, of these four alternatives to the self-interpretation crisis of modern subjectivity, the first ultimately had a more lasting influence on the philosophical scene, marking, point to point, this last breath of modernity that some call post-modern and flowing into the present situation of “hyperincommensurability” between subjectivity and nature diagnosed by Bruno Latour. The crisis of subjectivity thus becomes a crisis of philosophy, which ends a hostage to the syndrome of the house taken. (shrink)

“On Why in Philosophy Examples Matter”. The purpose of the article is to show the need of using examples in philosophy, associating to them four functions: to illustrate, explain, argue and show. Among other assertions, we attempt to justify the following: a) Examples are, as well as illustrations, evidences; such that what may be seen as an act of didactic generosity may be considered properly as the response to an always possible demand. b) The introduction of philosophical concepts requires frequently (...) a mutual cooperation between definition and example; the need of the latter in conceptual explanation is condoned by a reflection on the following of rules. c) A certain overrating of the counterexample and underrating of the example are tokens of a notion of philosophy put here into question. d) In Wittgenstein and other authors, a little heeded function of some examples is detected: of showing an alternative way of viewing the matter, of re-describing ancient philosophical themes. Towards the end, the issue of the example is assumed –this time– as an example of a more general issue: that of the relation between rhetoric and philosophy. (shrink)

El diácono permanente está llamado non ad sacerdotium sed ad ministerium episcopi. Su lugar eclesial y eclesiológico queda claro y, sin embargo, quedan todavía muchas dudas, críticas y actitudes de desconfianza hacia el diaconado. The present text follows three general objectives, which, at the same time, build its structure. Firstly, I would like to present and question Bernard Williams’ description of the virtue of accuracy. Secondly, I´ll try to complement Williams’ description by analyzing two dimensions of accuracy: care, on one side, and what I call “proximity to the problem”, on the other side. Related to that last issue, I add an excursus about writing. The third and last part of this article is an (...) attempt to relate the discussion about the so called virtues of truth —sincerity as well as accuracy— with the issue of self-deception. Specifically, I try to a) support Mele´s deflationary account of self-deception as motivationally biased belief, b) make an adjustment to this conception, and c) complement it with another aspect which has not received enough consideration in the discussion about self-deception, namely some beliefs we don´t generate or that manifest a high lack of accuracy. It is commonly argued that Hans-Georg Gadamer’s hermeneutics rests upon a criticism of the method of natural sciences that, by establishing a monopoly of what might be deemed as true knowledge, would exclude different forms of non-scientific experiences of truth. Thus, the article aims first at examining this assumption based on an analysis of his hermeneutic dialectics and ontology of language, which he develops in the third part of Truth and Method. This analysis reveals that his criticism of scientific method (...) rests upon the idea that the being is related to the happening of meaning and of human beings as individuals whose understanding of the world is questioned and caused by such happening. These ontological approaches make possible to characterize what might be thetrue method of thinking and access to truth. Secondly, the article aims at identifying three methodologicalprinciples that would guide a genuine exercise of hermeneutic thinking: a) The principle of determining the topos of understanding, which demands to reveal the relations of meaning that connect us to what we desire to understand; b) Principle of correction, which makes possible that understanding continuously “improves” both our interpretations and self-descriptions that actors provide of their own actions; and c) Principle of sensitivity towards happening, which demands to carefully listen to every possible relation of meaning that shape phenomena, as well as to the variations and mutations of meaning they experience. Daí, Wittgenstein responde em três momentos: (a) primeiro ele brinca e experimenta com as ideias de Frege para examinar o seu significado, (b) depois ele começa a apresentar as suas próprias ideias sobre a lógica, desafiando o ponto de vista de Frege, (c) e finalmente ele busca um acordo com Frege, deixando um quebra-cabeça para nós: (...) a ideia de uma técnica do pensamento. Daí, é a nossa vez de entrar na conversa, e a nossa participação se desenrola em dois momentos: (a) primeiro nós introduzimos ideias de Turing para articular a noção de um mecanismo de duas alavancas, (b) e depois nós esboçamos um entendimento da técnica do pensamento em termos desse mecanismo. In this article, based on a critical metaphor analysis, we identify and describe multimodal metaphors involving the human body and its conceptualizations in five auteur films of the 2010s. Studies on the human body in cinema have documented how it changes according to underlying ideologies. Our research focuses on the role of image schemas and metaphors as they embody meanings and sociocultural paradigms. Metaphors also frame how the body is conceptualized according to dominating ideological practices such as (a) commodification, (b) (...) the integration between artificial and organic, (c) dissatisfaction, (d) dynamics of beautification and idealization, and (e) politicization of the human body. We show how metaphors are creative tools to reframe meanings and representations of the body and how the body is a construct refashioned within the cinematic discourses of these films. (shrink)

Too much is claimed for this book by its title and by the blurb. The essays published in it were prepared in connection with a course of lectures, organized by the British Council, for non-British philosophy teachers, and held at Peterhouse, Cambridge, in the summer of 1953. The course was a good one; but it did not amount to an adequate picture of British Philosophy in 1953; and it is too much to claim that “it is not only an authoritative (...) review of some of the outstanding recent developments in British Philosophy, but also a significant contribution to these developments.” As a record of what the most vocal British philosophers are saying to-day, it is not so helpful as the less pretentious B.B.C. and Oxford symposia, The Revolution in Philosophy, and The Nature of Metaphysics. As a guide to what is going on in British philosophy to-day, it compares very unfavourably with H. D. Lewis’s symposium, Contemporary British Philosophy. (shrink)

Descriptively many Protestant perspectives on access to health care share much in common with secular accounts…perhaps too much. A normative account of a Protestant perspective on access to health care must be perceptively qualified by the Christ story. A genuinely theocratic approach may not lead one to the conclusion that the faith commits us to the notion of equality; rather the faith commits us to the notion of care. What counts as care may not be the same in every instance (...) (if this is indeed what equality means; in ordinary use, equality is tantamount to sameness). The Christ story reminds us who we are, beloved, sinful, redeemed. Acting out this story is to accept, to give, and to receive reconciliation. For many Christians this will mean that we are called to deny ourselves “equal” access to the system (as if equality actually existed!). (shrink)

John Dewey expresses repeatedly that the significance of democracy is more than political discourse. He invites us to realize that democracy is primarily moral idea that animates a process of living and should be actualized continuously. He underlines that the idea of liberty, equality and fraternity, which is the democratic trinity, is ethical ideal of humanity in which personality is at the centre of reflection. Every human individual is free to actualize its self-realization. His liberty is based on the belief (...) that every human individual has a right to equal opportunity with every other person to develop whatever endowment he has. Then, democracy indicates fraternity as an ethical value, which every human individual is able to actualize his capacities only in actively cooperative relationship with other. Political and social democracy presenting in a real association of life will be effectively sustained if its values of ideal hu-manity becomes an animating force of life. In other words, he envisions that democracy becomes a personal way of life. Keywords: values of democracy, social responsibility, culture of democracy, transformation of life, peaceful life. This paper examines the effects of employees’ sense that they work for a purpose-driven company on their workplace sustainability behaviors. Conceptualizing corporate purpose as an overarching, relevant, shared ethical vision of why a company exists and where it needs to go, we argue that it is particularly suited for driving employee sustainability behaviors, which are more ethically complex than the types of employee ethical behaviors typically examined by prior research. Through four studies, two involving the actual employees of construction companies, (...) we demonstrate that purpose drives the sustainability behaviors of employees by causing them to take psychological ownership of sustainability. In addition, we show that the sustainability-enhancing effect of purpose is stronger when employees perceive that they have higher autonomy in enacting their sustainability actions and for those employees for whom being moral is more central to their sense of self. Singing and praying in the words of biblical men and women is basic to sacramental mimesis, i.e., Christian imitation of the actions of the saints with the intention of thereby opening themselves to grace. This evidence counters the “voiceless victim” paradigm prevalent in much feminist scholarship. In pre-Christian Jewish liturgy, the song of Miriam after the Crossing of the Red Sea was already important in the annual celebration of the Passover. Jesus emphasized the spiritual equality of the sexes in his (...) teaching and ministry, and this led to increased visibility for women in Christian tradition: Susanna was the first of at least eight women interpreted as types of Christ. She was presented this way even within the synoptic Gospels themselves [see “Aneboesen phone megale: Susanna and the Synoptic Passion Narratives,” forthcoming in Gregorianium]. Moreover, the practice of presenting examples from both sexes in sermons and church decoration was so pervasive as to constitute a pastoral program of the Church. Such balanced representation of the sexes is found in both texts and art. The linguistic range of the evidence for the singing of women’s words includes Greek, Latin, Coptic, Syriac, Slavonic, and German. The artworks depicting women are from throughout the Christian world, including Dura Europos, Jerusalem, Egypt, Ethiopia, Cyprus, Syria, Armenia, Italy, France, Belgium, Germany. More than twenty biblical women are treated in the essay. Women’s words, quoted from the biblical record or imaginatively supplied, became the prayer of the whole congregation. Miriam’s words remain focal universally on Holy Saturday. The acclamations of Elizabeth and of the Virgin Mary became prominent early in both East and West . Both Byzantine and Gregorian chant commemorated them and other women such as Eve, Esther, Judith, Sarah , Susanna, Martha of Bethany, the Samaritan woman, the Canaanite woman, the woman with the ointment, the Samaritan woman, the ten virgins of the parable , and especially the Holy Women at the Tomb . Their proclamation of the Lord’s rising became particularly important in Byzantine resurrection hymns used at Easter and year-round. With four other first-century female saints– Junia, Mariamne, Photina and Thecla– Mary Magdalene was deemed ἰσαπόστολος “equal to the apostles,” because the angel commissioned her to announce the Lord’s Resurrection to the disciples. Martha’s profession of faith is the fullest recorded in the Gospels and became the basis for a Byzantine communion prayer . Repeatedly, one finds that women’s words were sung at important Sunday feasts and during Holy Week. In Gregorian chant their words were sung over the course of several days. Susanna’s words are readily found in fifty Gregorian chant manuscripts from the ninth through fifteenth centuries, used in cathedrals, in monasteries and other religious houses, and in parish churches; an appendix lists these manuscripts. Throughout the continent–in Italy, Austria, Slovenia, Germany, Switzerland, France, The Netherlands, England, Wales–the varied communities of the church sang Susanna’s words. Moreover, her words as mediated through Gregorian chant were quoted by Bernard of Clairvaux in a sermon and by Hermann of Scheda in his account of his conversion from Judaism. These men used Susanna’s words to evoke her as a type of Christ and thereby to seek to be like him themselves. That is, they experienced sacramental mimesis through singing women’s words. (shrink)

A typical decision is broken down into its essential requirements and processes, thus displaying the components of its framework. The process leads to the identification of a number of concerns.
